1. About these terms

These Terms govern your use of dolcesail.com (the "Site") operated by PIXELO MOBILE LTD, a private limited company registered in England & Wales (company no. 10585806), trading as "DolceSail" ("we", "us"). By using the Site you agree to these Terms; if you don't, please don't use it.

2. What DolceSail is, and what it is not

DolceSail is a concierge and directory for charter vessels in Italy. We catalogue vessels, route inquiries between you and the operator, and earn a commission from the partner agency on confirmed bookings.

DolceSail is NOT the contracting party for any charter. The contract for the charter, the deposit, the balance payment, and the on-water service are all between you and the partner agency (a licensed Italian charter operator or a professional captain). The partner agency's own terms govern the booking. We disclose the partner agency for every partner-fulfilled vessel on the listing page.

We are not a travel agent under UK Package Travel and Linked Travel Arrangements Regulations 2018; we don't organise packages, hold guest funds in escrow, or issue charter contracts.

3. Eligibility and account

You must be at least 18 to use the Site or to submit an inquiry. You may register an account; you're responsible for keeping your credentials secure and for activity on your account. We may suspend or close accounts that abuse the Site, in our reasonable judgment.

4. Inquiries and bookings

  • Submitting an inquiry is free and creates no contract.
  • We forward your inquiry (initially anonymised) to the partner agency, then introduce you with full contact details when you confirm you want to proceed.
  • The booking contract is between you and the partner agency. They handle pricing, availability, the charter agreement, payment, refunds, and cancellation. Their terms apply, not ours.
  • We do not guarantee availability or pricing. Listings are informational; the partner agency confirms.

5. Captain accounts and listings

If you operate a vessel and list it on DolceSail under a captain account, you warrant that you are authorised to do so, that the listing information is accurate, and that you hold the licences and insurance required to operate charters in Italy. Subscription tier perks are described on the captain subscription page and may change with reasonable notice.

6. Acceptable use

You may not:

  • Submit false or misleading inquiries.
  • Scrape vessel data, pricing, or contact details at scale.
  • Attempt to circumvent the broker flow to bypass commission.
  • Upload content you don't have rights to.
  • Use the Site to launder, defraud, or break Italian, EU, or UK law.

7. Intellectual property

The Site, brand, design, and software are owned by PIXELO MOBILE LTD. Vessel photos and descriptions remain the property of the captain, partner agency, or original photographer; they are licensed to DolceSail for use on the Site for the purpose of marketing the vessel.

8. Liability

To the maximum extent permitted by law, PIXELO MOBILE LTD is not liable for the conduct, acts, or omissions of any partner agency, captain, or crew, including (without limitation) cancellations, vessel condition, on-water safety, or service quality. Your remedy for any such matter is against the partner agency under the booking contract.

Nothing in these Terms limits DolceSail's liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be limited under English law.

9. Indemnity

You agree to indemnify DolceSail against any claim arising from your breach of these Terms or your use of the Site in violation of law.

10. Changes

We may update these Terms occasionally. Material changes will be reflected on this page; the "last updated" date is always current. Continued use of the Site after a change constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute relating to these Terms or your use of the Site is subject to the exclusive jurisdiction of the English courts. Booking disputes are governed by the partner agency's contract and its governing law (typically Italy).
